The Election Clause

In his lawsuits, Joe Miller has alleged that the “Elections Clause” of the US Constitution was violated by the State of Alaska.

For those of you who don’t know, here is the Elections Clause from the US Constitution:

Article I, Section 4:


Section. 4.

The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators.


As you might imagine, this short paragraph has been the subject of a lot of litigation and interpretation over the past few centuries.
